1. Acceptance of Terms

Welcome to SelfAI - AI Photo Studio ("the App"), operated by Rocket Digital Limited ("we," "us," or "our"). By accessing or using our application, website at https://www.ai-photo.app, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Rocket Digital Limited. You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

SelfAI - AI Photo Studio is an AI-powered photo generation application that allows users to upload selfies and personal photographs to create professional headshots, portraits, and stylized images using artificial intelligence. The Service offers over 30 styles including professional headshots for LinkedIn, business portraits, ID photos, and creative styles.

The Service leverages third-party AI and cloud platforms including OpenAI, Microsoft Azure, Replicate, and Fal.ai to process and generate images. The availability and quality of generated images may vary depending on these third-party services and the input photographs provided.

3. User Accounts

To use certain features of the Service, you may be required to create an account. Account authentication is managed through Firebase. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms or if your account has been compromised.

4. User Content

Uploaded Photos.When you upload selfies or other photographs ("User Content") to the Service, you retain ownership of your original images. By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Content solely for the purpose of providing and improving the Service, including training AI models to generate images on your behalf.

Generated Images.Images created by the AI based on your User Content ("Generated Images") are provided to you for your personal and commercial use, subject to these Terms. You may use Generated Images for personal profiles, professional portfolios, social media, and similar purposes.

Content Deletion. You may request the deletion of your User Content and Generated Images at any time by contacting us at hello@rocketdigital.ai. Upon receiving a valid deletion request, we will remove your content from our active systems within a reasonable timeframe, though residual copies may persist in backups for a limited period.

Representations. You represent and warrant that you own or have the necessary rights to all User Content you upload, that your User Content does not infringe on the intellectual property or privacy rights of any third party, and that you have obtained consent from any identifiable individuals depicted in your uploaded photographs.

5. Acceptable Use

You agree not to use the Service to:

• Upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Create deepfake or misleading content intended to deceive others about the identity of the person depicted.
• Upload photographs of individuals without their consent.
• Generate content depicting minors in any inappropriate or exploitative context.
• Use the Service for fraudulent purposes, including creating fake identity documents or impersonating others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service or its underlying AI models.
• Circumvent, disable, or interfere with any security features of the Service.
• Use automated scripts, bots, or other means to access the Service in a manner that exceeds reasonable usage.
• Resell, redistribute, or sublicense access to the Service without our prior written consent.

We reserve the right to remove any content and suspend or terminate accounts that violate these acceptable use guidelines, at our sole discretion and without prior notice.

6. AI-Generated Content

The Service uses artificial intelligence to generate images based on your uploaded photographs. You acknowledge and agree to the following:

• AI-generated images are produced by machine learning models and may not perfectly represent your actual appearance. Results can vary in accuracy, quality, and likeness.
• Generated images may occasionally contain artifacts, distortions, or inaccuracies inherent to the AI generation process.
• We do not guarantee that Generated Images will be suitable for any particular purpose, including official identification documents or legal use.
• The AI models used may produce different results from the same input at different times due to the probabilistic nature of the technology.
• You are solely responsible for reviewing Generated Images before using them and for ensuring their appropriateness for your intended use.

We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of any AI-generated content produced through the Service.

7. Subscriptions and Payments

The Service offers both free and premium subscription plans. Premium features are available through in-app purchases and subscriptions managed via RevenueCat, processed through the Apple App Store or Google Play Store.

Billing. Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually, depending on the plan selected). Payment is charged to your Apple ID or Google Play account at confirmation of purchase.

Auto-Renewal. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

Managing Subscriptions.You can manage or cancel your subscription through your device's App Store or Google Play Store settings. Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until that date.

Refunds. Refund requests are subject to the policies of the Apple App Store or Google Play Store. We do not process refunds directly. Please contact Apple or Google for refund inquiries.

Price Changes. We reserve the right to modify subscription pricing at any time. Any price changes will take effect at the start of the next billing cycle following notice of the change. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

8. Advertising

The free version of the Service may display advertisements served by Google AdMob. These advertisements may be personalized based on your usage data and device information, subject to our Privacy Policy. Premium subscribers may enjoy an ad-free experience as part of their subscription benefits.

9. Intellectual Property

The Service, including its original content (excluding User Content and Generated Images), features, functionality, design, source code, and underlying technology, is and remains the exclusive property of Rocket Digital Limited and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of Hong Kong and international jurisdictions.

The SelfAI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Rocket Digital Limited. You may not use such marks without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in the Service or its content other than the limited right to use the Service in accordance with these Terms.

10. Analytics and Tracking

We use Google Analytics and Meta Pixel to collect anonymized usage data and analyze how the Service is used. This helps us improve the Service and understand user behavior. By using the Service, you consent to the collection and processing of data by these analytics providers. For more details on what data is collected and how it is used, please refer to our Privacy Policy.

11. Disclaimers and Limitation of Liability

Disclaimer of Warranties.THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE.

Third-Party Services. The Service relies on third-party platforms and services including OpenAI, Microsoft Azure, Replicate, Fal.ai, Firebase, RevenueCat, Google AdMob, Google Analytics, and Meta Pixel. We are not responsible for any failures, outages, or issues caused by these third-party services.

Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROCKET DIGITAL LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED HONG KONG DOLLARS (HKD 100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rocket Digital Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your User Content, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by discontinuing use of the Service and contacting us at hello@rocketdigital.ai to request account deletion.

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong. You irrevocably submit to the jurisdiction of such courts and waive any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inconvenient forum.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, either by posting a notice within the App or by sending a notification to the email address associated with your account.

Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service.
